Terms of Service
These terms form a binding agreement between you and The operator of Tubask for use of Tubask at tubask.app.
1. The service
Tubask provides a hosted Model Context Protocol (MCP) server that lets AI assistants (e.g. Claude, Cursor) search YouTube, summarize videos, and retrieve transcripts using your own Google YouTube Data API key. We provide account management, OAuth linking, usage metering, and optional paid plans.
2. Eligibility
You must be at least 16 years old and able to form a binding contract in your country. By creating an account, you confirm this and that the information you provide is accurate.
3. Your account
- You are responsible for keeping your password confidential.
- You must provide a valid email and maintain access to it.
- You may delete your account at any time in Settings. Deletion is permanent and removes stored API keys and OAuth links.
- Notify us immediately at support@tubask.app if you suspect unauthorized access.
4. Your YouTube API key
- You must supply your own Google Cloud API key with YouTube Data API v3 enabled, unless we explicitly offer a hosted trial (20 calls on signup where applicable).
- You are responsible for compliance with Google's YouTube API Services Terms and YouTube's Terms of Service.
- Quota consumption on your Google project is your responsibility. We are not liable for Google billing or quota exhaustion on your key.
5. Acceptable use
You agree not to:
- Use the service for unlawful purposes or to violate third-party rights
- Attempt to bypass rate limits, authentication, or security controls
- Scrape or overload YouTube or our infrastructure at abusive volume
- Resell or sublicense the service without written permission
- Reverse engineer the service except where law permits
- Upload malware or interfere with other users
We may suspend or terminate accounts that violate these terms.
6. Plans, billing, and withdrawal
- Free and paid plans are described on the pricing page and in your dashboard. Paid subscriptions are billed via Stripe.
- EU consumers: if you are a consumer in the European Union, you may have a 14-day right of withdrawal for distance contracts. By starting to use the paid service immediately after purchase, you may be asked to acknowledge that you lose the withdrawal right once full performance begins — as permitted by consumer law.
- You may cancel subscriptions via the billing portal. Access continues until the end of the paid period unless otherwise stated.
- Prices include applicable VAT where we are required to collect it.
7. Intellectual property
We own the Tubask software, branding, and documentation. You retain rights to your API key and the content you obtain from YouTube subject to Google's and rightsholders' terms. We grant you a limited, non-exclusive, revocable license to use the service for its intended purpose.
8. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may modify features, limits, or pricing with reasonable notice for material changes affecting paid subscribers.
9. Disclaimer
The service is provided “as is” to the extent permitted by law. YouTube data comes from Google; we do not warrant accuracy, completeness, or availability of third-party APIs. Nothing in these terms excludes liability that cannot be excluded under EU consumer law.
10. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim arising from the service is limited to the fees you paid us in the 12 months before the claim, or €100 if you are on a free plan — except where mandatory law (including EU consumer protection) provides otherwise.
11. Indemnity
You will indemnify us against claims arising from your misuse of the service, your API key, or your violation of Google/YouTube terms, except to the extent caused by our negligence or willful misconduct.
12. Termination
Either party may terminate by closing the account or discontinuing use. We may suspend or terminate for breach with notice where reasonable. Provisions that by nature should survive (liability limits, governing law, payment obligations) survive termination.
13. Governing law and disputes
These terms are governed by the laws of the European Union, without regard to conflict-of-law rules. If you are an EU consumer, you also benefit from mandatory protections of your country of residence. Courts of the European Union have jurisdiction unless consumer law grants you the right to bring proceedings in your home country.
EU consumers may use the European Online Dispute Resolution platform. We are not obliged to participate in consumer arbitration boards unless required by law.
